Lovins Trosclair obtained a $1,737,500 recovery on behalf of a widow and her children due to the wrongful death of a construction worker. Plaintiff’s alleged that the construction worker was doing roofing work at a commercial construction site without proper fall protection equipment. While the construction worker was trying to lay down roof decking, a strong gust of wind caught the decking, causing the construction worker to fall to his death. Our trial team faced substantial legal hurdles, including difficult Texas law that protects general contractors from liability and workers compensation protections that required us to show gross negligence against his employer. After multiple legal battles, including fending off efforts to get the case dismissed, we were able to obtain a favorable settlement for our clients on the eve of trial.
