A client was severely injured and suffered traumatic brain injuries after a collision with a company’s Ford Super Duty F450 truck. With the help of accident reconstructionists, life-care planners, and economic loss specialists, Pete Trosclair and Michael Lovins proved that the company driver caused significant physical and mental injuries to our client that will substantially impact her for the rest of her life.

Lovins Law obtained a $1,737,500 recovery on behalf of a widow and her children due to the wrongful death of a construction worker. Plaintiff’s alleged that the construction worker was doing roofing work at a commercial construction site without proper fall protection equipment. While the construction worker was trying to lay down roof decking, a strong gust of wind caught the decking, causing the construction worker to fall to his death. Our trial team faced substantial legal hurdles, including difficult Texas law that protects general contractors from liability and workers compensation protections that required us to show gross negligence against his employer. After multiple legal battles, including fending off efforts to get the case dismissed, we were able to obtain a favorable settlement for our clients on the eve of trial. Pete Trosclair recovered $1,200,000 for a pedestrian who was struck by a truck while standing on the side of the road next to his broken down vehicle. Pete was able to establish that the driver of the truck was drunk and acting within the course and scope of his employment at the time of the incident, thereby making the truck driver’s employer liable for his actions. Pete’s client suffered severe injuries and required surgery for internal bleeding. A portion of this recovery was also for the minor son of the client pursuant to a bystander claim because he witnessed the entire incident.

Lovins Law obtained a settlement of $1,200,000 on behalf of a young girl that sustained a skull fracture due to a fall. $451,626 in attorney fees and expenses.

Lovins Law recovered $1,000,030 on behalf of the family of a 90 year old man who was struck by a courier while walking into the hospital for a regular checkup. He sustained a broken hip and later succumbed to his injuries. We were able to obtain this favorable settlement without filing a lawsuit.

Pete Trosclair recovered $1,165,000 for a client involved in a trucking accident. Plaintiff alleged that the commercial truck crossed into his lane of traffic, and despite his efforts to avoid the truck, the vehicles collided head-on causing serious injuries to Plaintiff, including burns to his body and severe injuries to his leg. Lovins Law was able to obtain a settlement for $800,000 without filing a lawsuit on behalf of a man who sustained a severe leg injury in a ATV rollover accident.

Lovins Law obtained a hard-fought settlement of $750,000 for a small business that facilitated an acquisition by a private equity fund of a smaller company, but refused to pay the contractual fee owed our client.

Pete Trosclair recovered $600,000 for the mother of an adult child in a wrongful death claim involving a motorcycle accident with disputed liability as to how the collision occurred. There were allegations that Pete’s client’s son was speeding at the time of the incident. Pete was able to establish that the driver of the car that collided with the motorcycle was in the course and scope of his employment, thereby making his employer liable for his actions.

A man was severely injured in a car wreck and had to be rushed to the hospital to have his spleen removed, but could not recall any details about how the wreck occurred. The other driver blamed the man for the wreck. After a thorough investigation and accident reconstruction, Michael Lovins was able to recover the maximum limits of all available insurance.

Lovins Law obtained a confidential settlement on behalf of their clients, the wife and children of a construction worker who fell to his death from a radio tower he was assembling. Plaintiffs’ alleged that a piece of equipment used to construct the tower was negligently maintained, causing the equipment to fail and the workers to fall hundreds of feet to the ground.

Pete Trosclair was able to obtain a $300,000 recovery for a plaintiff who sustained serious injuries to his leg in a trucking accident. Pete Trosclair took on this case after another firm dropped it. Pete retained an expert who recreated the accident scene, which showed that the driver of an 18 wheeler pulled from the shoulder onto the roadway directly in front of my client in an effort to make a right hand turn. Pete was also able to track down a witness who confirmed the events as described by the expert witness and the client.

Lovins Law obtained a settlement of $340,000 on behalf of a minor who was a passenger in a car hit by an irresponsible driver. The minor child broke his finger and clavicle in the collision. The settlement proceeds were placed in trust until the child turn 18.

Pete Trosclair was able to recover $275,000 for the adult children of a patient who died as a result of medical malpractice during surgery. Plaintiff’s alleged that the anesthesiologist breached the standard of care by failing to pay proper attention to the patient and allowing her to be deprived of oxygen for an extended period of time, resulting in her death. This case was subject to the medical malpractice caps of $250,000 for non-economic injuries.

Lovins Law were able to obtain a $250,000 recovery on behalf of a truck driver who suffered a broken ankle when a forklift backed over his leg while attempting to unload his truck. Plaintiff alleged that the forklift driver was operating the forklift in a negligent manner by traveling in reverse and that the company failed to install proper warning devices such as a reverse alarm.

Lovins Law obtained a $215,000 recovery on behalf of their client and her son who collided with a street sweeper in a construction zone. A thorough investigation by Lovins Law revealed that the construction company did not use safe practices to warn traffic that construction vehicles were present and may not be visible. By breaking these basic safety rules, the construction company caused a severely broken leg, multiple surgeries, several months off work, and severe stress.

Pete Trosclair recovered $200,000 on behalf of a small business owner for breach of contract claims as well as claims for trade dress, trademark, and copyright violations related to a marketing campaign created by the Plaintiff. (Attorney’s fees totaled $80,000.00 and case expenses totaled $93,418.69).

Michael Lovins was able to obtain a $200,000 recovery on behalf of a client who suffered a herniated disc in a car wreck. The insurance company argued that the crash was low impact and could not have caused a herniation.

Pete Trosclair was able to recover $190,000 in a civil rights case on behalf of a Dallas County inmate. Plaintiff alleged that Dallas County failed to provide him adequate medical care after he was struck in the eye by another inmate, causing his detached retina to go unrepaired and leading to blindness in one eye.

A law enforcement officer in a Texas county reported the illegal acts of the sheriff and was promptly fired. Michael Lovins sued the county on the officer’s behalf and obtained a settlement of $187,500 plus full reinstatement of all retirement benefits, including health insurance.

Lovins Law obtained a $100,000 recovery on behalf of a minor whose face was injured at a waterslide park. The waterslide park failed to properly maintain its equipment, causing the boy to crash into the wall at the end of the waterslide, breaking his nose.

An African-American employee of a Texas municipality was passed over for a promotion in favor of a new white employee, in spite of the African-American’s substantially greater qualifications. Lovins Law represented the African-American employee and obtained a settlement in a race discrimination claim for $50,000, plus transfer to a new facility within the municipality.
